For the rest of this Agreement, these will be referred to as Quivre Services.
Please carefully read both this Agreement and the accompanying Privacy Policy before accessing or using a Quivre Service.
Quivre Services are operated by Taoensso UG (haftungsbeschränk) (referred to as Quivre, I, me, my). The terms in this Agreement constitute the entire agreement between Quivre and the user of a Quivre Service (referred to as you, your).
By accessing or using any Quivre Service in any way, you agree to and are bound by both this Agreement and the accompanying Privacy Policy.
I reserve the right to amend this agreement or any parts thereof at any time and without notice, and your continued use of any Quivre Service implies your acceptance of the Agreement as amended.
If any provision in this Agreement is deemed invalid, void, or for any reason unenforceable, the remaining provisions will continue in full force without being impaired or invalidated in any way.
This Agreement shall be governed by and interpreted according to the laws of Germany. If you are accessing any Quivre Service from outside of Germany, you are responsible for compliance with all local laws.
As a condition of using any Quivre Service, you agree that any and all disputes and causes of action arising out of or connected with any Quivre Service, shall be resolved through arbitration, with such arbitration to be held in Berlin, Germany.
All notices under this agreement shall be in writing and shall be deemed to have been duly given when the receipt is electronically confirmed, if transmitted by facsimile or e-mail or upon receipt, if sent by certified or registered mail, return receipt requested.
You must be 18 years of age or older to visit or use any Quivre Service in any manner. By using a Quivre Service or accepting this Agreement, you represent and warrant to Quivre that you are 18 years of age or older, and that you have the right, authority and capacity to agree to and abide by this Agreement. You also represent and warrant to Quivre that you will use any Quivre Services in a manner consistent with any and all applicable laws and regulations.
The contents of all Quivre Services (including the Quivre quiz questions) are Copyright 2018-2020 Taoensso UG (haftungsbeschränk) and may not be copied or otherwise reproduced without my written permission. All rights, including all moral rights of Quivre and my employees/agents, are reserved unless expressly granted.
My servicemarks, trademarks, registered trademarks and trade dress include, but are not limited to the "Quivre" name, the "(un)shackle your sex life" slogan, the "what's your code?" slogan, the Quivre logo, and the distinctive Quivre branding.
Fair use of my servicemarks and trademarks in advertising and promotion of my services and products requires proper acknowledgement. All other servicemarks and trademarks not owned by me or my affiliates that appear on any Quivre Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by me or my affiliates.
All Quivre Services are provided on an "as is" and "as available" basis without representations or warranties of any kind, whether express or implied, including but not limited to warranties of title, non-infringement, or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are incapable of exclusion under law.
Neither I nor any of my directors, employees, affiliates or agents shall be liable for any damages or loss or liability of whatsoever nature resulting from or relating to the use of or inability to use any Quivre Service, irrespective of the cause of the damages. This includes any violation of this Agreement or any action arising from the personal information that you upload to any Quivre Service or that invades the privacy of any third party.
Your accounts for any Quivre Services are private and should not be used by anyone other than you. You are solely responsible for maintaining the confidentiality of your passwords for any Quivre Services, and for all usage or activity on any Quivre Service by users using your password.
I take every precaution to protect the personal information of my users, including following industry best practice guidelines wherever possible. However no internet system is completely secure, and I cannot assume responsibility for information theft in the event of a security breach.
Quivre Services may contain links to other websites or services that are not operated or controlled by me. Use of these links is at your own risk and you acknowledge that I am not responsible for, and have no liability as a result of the availability of these links or their content.
Quivre Services are for personal use only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not join and use any Quivre Service for any purpose.
Use of any Quivre Service is with my permission and I may, in my sole discretion, terminate, suspend or limit your access to all or parts of any Quivre Service at any time, with or without notice, for any reason, including without limitation, breach of this Agreement.
Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity, or activity that may otherwise affect the enjoyment of any Quivre Service or the Internet by others may be grounds for termination of your access to all or part of any Quivre Service at my sole discretion, and I may refer you to appropriate law enforcement agencies.
